TrueMark Certified Sales provides an online platform for browsing certified pre-owned vehicle inventory, obtaining vehicle information through VIN decoding, communicating with our dealership team, scheduling appointments, and accessing AI-powered vehicle recommendations. 3. User Accounts

• You may create an account using Google OAuth or email/password registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information when creating an account.
• You must be at least 18 years old to create an account and use our services.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Vehicle Information Disclaimer

Vehicle listings, specifications, pricing, VIN reports, safety ratings, fuel economy data, and other vehicle information provided through our Service are presented for informational purposes. While we strive for accuracy:

• Vehicle data from NHTSA, EPA, and other sources is provided "as-is" from public government APIs.
• Prices, availability, and vehicle conditions are subject to change without notice.
• Photos may not reflect the exact current condition of a vehicle.
• AI-generated recommendations and analyses are for informational purposes only and should not be the sole basis for purchasing decisions.
• We recommend an independent inspection before any vehicle purchase.

5. AI-Powered Features

Our Service includes AI-powered features (powered by Anthropic's Claude) for vehicle analysis, customer assistance, and recommendations. By using these features:

• You acknowledge that AI-generated content may not always be accurate or complete.
• AI responses do not constitute professional advice (financial, legal, or mechanical).
• Your interactions with the AI assistant may be processed to generate responses but are not used to train AI models.
• You agree not to input sensitive personal information (Social Security numbers, financial account details) into AI conversations.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Scrape, crawl, or use automated tools to extract data from the Service without written permission.
• Attempt to gain unauthorized access to our systems, accounts, or data.
• Interfere with or disrupt the Service or its infrastructure.
• Impersonate another person or entity.
• Submit false or misleading information in lead forms or communications.
• Use the Service to send spam, unsolicited messages, or phishing attempts.

7. Intellectual Property

Our Service integrates with third-party services including Google (authentication), WhatsApp (messaging), NHTSA/EPA (vehicle data), and Anthropic (AI). Your use of these integrations is also subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUEMARK CERTIFIED SALES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10. Indemnification

You agree to indemnify and hold harmless TrueMark Certified Sales, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

Any disputes arising from these Terms or the Service shall be governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. You agree to resolve any disputes through binding arbitration in Atlanta, Georgia, except where prohibited by law. You retain the right to bring claims in small claims court if eligible.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) shall survive.
